Titre : Algorithmic Rule By Law : How Algorithmic Regulation in the Public Sector Erodes the Rule of Law Type de document : texte imprimé Auteurs : Nathalie A. Smuha, Auteur Editeur : Cambridge University Press Année de publication : 2025 Importance : 355 p ISBN/ISSN/EAN : 978-1-00-942746-3 Langues : Anglais (eng) Résumé : With the promise of greater efficiency and effectiveness, public authorities have increasingly turned to algorithmic systems to regulate and govern society. In Algorithmic Rule By Law, Nathalie Smuha examines this reliance on algorithmic regulation and shows how it can erode the rule of law. Drawing on extensive research and examples, Smuha argues that outsourcing important administrative decisions to algorithmic systems undermines core principles of democracy. Smuha further demonstrates that this risk is far from hypothetical or one that can be confined to authoritarian regimes, as many of her examples are drawn from public authorities in liberal democracies that are already making use of algorithmic regulation. Focusing on the European Union, Smuha argues that the EU's digital agenda is misaligned with its aim to protect the rule of law. Novel and timely, this book should be read by anyone interested in the intersection of law, technology and government. Réservation

Titre : A European Social Union after the Crisis Type de document : texte imprimé Auteurs : Frank Vandenbroucke, Auteur ; Catherine Barnard, Auteur ; Geert De Baere, Auteur Editeur : Cambridge University Press Année de publication : 2017 Importance : 522 p ISBN/ISSN/EAN : 978-1-108-41578-1 Langues : Anglais (eng) Résumé : Today, many people agree that the EU lacks solidarity and needs a social dimension. This debate is not new, but until now the notion of a 'social Europe' remained vague and elusive. To make progress, we need a coherent conception of the reasons behind, and the agenda for, not a 'social Europe', but a new idea: a European Social Union. We must motivate, define, and demarcate an appropriate notion of European solidarity. We must also understand the legal and political obstacles, and how these can be tacked. In short, we need unequivocal answers to questions of why, what, and how: on that basis, we can define a clear-cut normative and institutional concept. That is the remit of this book: it provides an in-depth interdisciplinary examination of the rationale and the feasibility of a European Social Union. Outstanding scholars and top-level practitioners reflect on obstacles and solutions, from an economic, social, philosophical, legal, and political perspective.
- Reconsiders how the EU can be a successful union of flourishing welfare states in light of the lasting social and political impact of the crisis
- Combines retrospective historical analysis with up-to-date discussions of salient political issues, including the instability of the monetary union, Brexit, and the launching of a European Pillar of Social Rights by the European Commission
- Accessible features include summaries of the most cited European Court of Justice's judgments and an innovative analysis of the monetary union by a world leading academic in the fieldRéservation
